The US Govt Declares WAR on its Own Citizens

Well, it appears they have finally done it.  Our own congress, both the house and senate voted to authorize the military to arrest and detain indefinitely without charge, trial or recourse via Habeas Corpus, people (INCLUDING any US Citizens) who are suspected of being an enemy or linked to enemies of the United States.  Referred to as a “covered person”, any person citizen or otherwise can be detained indefinitely based on the gray area of a “belligerent act”.  This is simply an ACT OF TREASON.

The 2012 National Defense Authorization Act reads as follows:

Section 1031, a “covered person” is defined as follows:

(This includes American Citizens who live or act domestically or internationally).

  1.  A person who planned, authorized, committed, or aided the terrorist attacks that occurred on September 11, 2001, or harbored those responsible for those attacks.
  1. A person who was a part of or substantially supported al-Qaeda, the Taliban, or associated forces that are engaged in hostilities against the United States or its coalition partners, including any person who has committed a belligerent act or has directly supported such hostilities in aid of such enemy forces.

If you’re not accustomed to legalese, part 2 is the problem.  Let’s break this down.  The first part of the sentence sounds reasonable up to the Taliban.  It is the second portion outlined here in red where the ‘wicket gets sticky’ if you’ll pardon the pun.   “A person who was a part of or substantially supported al-Qaeda, the Taliban, or associated forces that are engaged in hostilities against the United States or its coalition partners, including any person who has committed a belligerent act or has directly supported such hostilities in aid of such enemy forces.

Essentially, any “associate forces”, (think militias, tea party activists, your humble author, alternate political parties such as the Constitution party, ad infinitum) that commits a “belligerent act”, (an undefined gray area filling a football stadium with tennis balls of potential actions) or supports those actors, (think your friends &  family for hiding you from the military once your ‘declared’, your publisher, your banker, your Mom who lends you money to get out of town, etc.) can and will be held in secret, indefinitely “until the end of the hostilities”.  So essentially if the war on terror is similar to the war on drugs, guns, poverty or any such other faceless, timeless undeclared war, you can expect to die in a military prison without ever having been able to communicate with your family, your lawyer or to take advantage of your constitutional rights to be faced by your accuser, charged, go to trial, appeal, etc, etc.

Further, this is an effective repeal of the Posse Comitatus Act.  It allows the military to act on domestic soil.  For the record, the Act itself is not what most people think.  Posse Comitatus was enacted in 1878 and provides far less defense against military action on domestic soil than is generally believed.  In reality, it does not prohibit the military from acting domestically to maintain “law and order” it does however require that congress or the constitution must originate and approve of that action.   Since the National Guard has been declared by President Bush to be subject to federal authority in an executive order, both they and the Coast Guard can act at any time.  (The Coast Guard is already considered an operational authority of Homeland Security).

It’s beginning to sound more like Soviet era Russia than the United States of America.  This is a giant leap forward into the open arms of tyranny and totalitarianism.  Our self-styled ‘leaders’ can attempt to justify this any way they want, but treason is treason.  They have taken an oath to guard and defend the Constitution of the United States of America and defend us and her against threats both foreign and domestic.  That includes our own government.

Our representatives in the senate have shown their true colors.  Even Obama, the treasonous AG Eric Holder and the Secretary of Defense have clearly stated publicly that the legislation is unnecessary or even harmful!  In fact, Obama has threatened to veto it if the congress passes it.  Hold on there… don’t start thinking that the dems are on your side.  They only disagree because it doesn’t give them enough power.   Obama wants the FBI to control who they lock away, not the military.  Utterly AMAZING.  Obama, who I’ll remind you is a constitutional professor, doesn’t have a problem with holding Americans in violation of the constitution, his only concern is who makes the decision!  It is increasingly apparent that neither party has the best interests of the American People in mind. They have violated their oaths on so many levels; moral, ethical and fiduciary, we would be wise to hearken to a quote from James Madison who wisely counseled;  “Crisis is the rallying cry of the tyrant.”  Funny that we seem to hear that crisis word in every speech, news story, headline and promise.

There were only two (2) Republicans and thirty-seven (37) Democrats in the Senate who voted against it.  The short list of senate conservatives was Rand Paul – Kentucky and Mark Kirk – Illinois.  Evidently these 39 senate naysayers are the only members of the senate that remember their constitutional oath to defend the people against tyranny both foreign and domestic.  This tyrannical addition or addendum to the already treasonous Patriot Act(s) cinches the noose around the necks of ordinary citizens who support change in our national government.  How easy it is now to simply declare opponents a ‘covered person’ enemy and poof.. they disappear.  We have entered the era of the US-CSA (United Socialist-Communist States of America).  Mark my words reader.  This will replace Pearl Harbor as THE day of infamy in our nation’s history.

If you haven’t noticed, the recent spate of legislation coming out of our congress, either you’re not paying attention or simply hoping that it’s not really happening.  This presidential administration and the statists who have a totalitarian agenda are focused almost exclusively on the diminution of our civil, human and constitutionally defended inalienable rights.  The plethora of legislation from the Department of Justice, the Environmental Protection Agency, Department of Education, Department of Homeland Security and other alphabet agencies is being inserted into the fabric of law in this nation.  These agencies are all unconstitutional on their face and the ‘rules’ they promulgate which are treated as law have no oversight, no outside review, no public scrutiny or other restraining power.  Tens of thousands of individuals already fill our jails and prisons based on crimes that are not really crimes but simply contrary to an agency ruling treated as legislated law.  Add this new legislation to the pack.  This is truly the beginning of the end of freedom and liberty in our nation.

Imagine giving Homeland Security and the military the authority to declare any citizen they choose as a ‘covered person’ aka enemy combatant.  Oh.. I know.  The legislation implies you have to be active with a stated enemy such as Al-Qaeda or other Muslim extremist group.  But with the knowledge that they can simply add stated enemies as “associated forces” how long do you think it will be before domestic groups, individuals and other ‘undesirables’ are considered part of the enemy list?

The knucklehead who recently fired 2 bullets into the White House window is a good example.  I’m not suggesting he should not be arrested and charged, but under the new law, he could simply be detained indefinitely with no recourse, no habeas appeal and barred access to counsel.  One mustn’t look too far into the future to see a Soviet Gulag style system in full play.  That is not what our nation, constitution, law and belief system is based upon.

Patriots Arise!  It is time to declare our sovereignty and unalienable rights.  Arise how, you ask?  Are you advocating violence or the overthrow of the government?  Absolutely not.  But you can take action in a host of effective ways.  Visit and or,,  If you don’t like the ideology or politics of one of the above, find another one.  Just remember that if you don’t take any action, you can’t whine since you are your only advocate.  No one else will do what needs to be done for you, your family or your children.  Don’t abdicate your responsibility to your family or your nation.

Ayn Rand has a quote which is very appropriate for this situation. “You can ignore reality… But you can’t ignore the consequences of reality.”   You can watch this all unfold around you, fail to plan and you’ll one day find yourself looking out through a chain link fence wondering what the heck happened.  So let’s not ignore the reality of our situation.  Below are a few items that are a good start down the road back to sanity.

Congressional Limits

  1. No person can run for any seat in either the house or senate for more than one (1) term.  Eliminate the need for a re-election campaign and you eliminate one of the best methods of bribery, er, lobbying.  After completion of your term you go back home to being a baker, tradesman or whatever you did before you chose to do a short term of civic duty.
  2. All persons who have completed a term in congress are banned from ‘consulting’, lobbying or any activity construed as lobbying for a period of five (5) years from the date of their last day in office.  Any individual found to be exerting influence in a post congressional period is subject to a felony charge with a minimum 10 year prison sentence.  Eliminate the motivation and you eliminate the violation.  Even the impression of impropriety should be discouraged.
  3. All persons who are active members of congress, or act in any capacity in any government position with policy or rule-making authority must place all assets and investments into blind trusts during their term in office and for a period of one (1) year from the date of their last day in office.  Remove the ability to game the system and you remove the temptation.
  4. All persons who are active members of congress, or act in any capacity in any government position with policy or rule-making authority are subject to double the punishment, including fines and prison terms, for any violation they may be found guilty of which involves their official capacity.  It’s really quite simple, if you accept the responsibility to act as a representative of the people, you accept the responsibility to be above reproach.  Government jobs and positions should no longer be looked upon as a ‘license to steal’.

Eliminate the nanny state:
We spend hundreds of billions to “keep us safe” from the threat of terrorism. If we have all heard that phrase once, we’ve heard it a thousand times. Politicians throw it around like candy. Yet, far more children alone die each year from accidental drowning than American citizens do from terrorism. But we willingly give up our personal sovereignty and privacy to our government to safe-guard against the infinitesimally minuscule percentage of risk that exists. Folks; let’s understand; Fear is the Risk.

Unfortunately in our country today, we fear the wrong risk. The risk we should truly fear is corrupt and incompetent leaders, egotists and statists who believe that they have the right to determine what is best for you, ideologues of all stripes, gold diggers, thieves in suits and cutthroats of all descriptions parading about as civic minded ‘servants’ of the people; these are the true dangers to our republic.

Those who would strip you of your right to speak, your right to determine what you spend your money on or how much of your earnings you can keep, to limit what you hear, to demand that they know what is best for you, to determine that some special class is more deserving of your money than you are;  these are the real dangers to us as a people and as a nation.

Behold a perfect example; just look at the war on terrorism. This is not a war on terror, it is an un-winnable conflict that is designed to maintain a sustainable cost basis to keep the nation’s debt high while providing an excuse for the rapid expansion of government ‘control’ and the graduated erosion of our rights as free individuals. The true leaders know that in order to maintain and grow control, you must keep all the sheeple united against a common and phantom foe. We fund hundreds of billions in military, humanitarian, social, “nation building”, democracy expansion/distribution programs and aid, all paid for with the blood of our children and our national treasure.  It’s like giving money to your favorite charity and finding out only 10% even goes to the target cause.

Furthermore, there is zero accountability and zero control over the ideology. In many cases we are actually funding both sides. How ironic. All this funding comes from the taxpayer because we know that no other income exists. What we cannot self-fund, we must borrow and in the case of China (almost 1 trillion), we actually are borrowing from, and simultaneously funding our sworn enemy. As a result, they have a significant level of influence on our global outlook, domestic decisions and an inordinate impact on our foreign policy.

Doubt it? Let’s take a look… we don’t have to go far; even recent history tells you the truth. Let’s look at some of our more recent “wars”.  Hmmm… well, we have the war on drugs, the war on crime, the war on poverty, the war on terrorism, the war on obesity, the war on hunger, the war on illegal immigration, the war on illiteracy, the war on cancer, the war on aids, and that’s just to name a few. Has it occurred to you that all these wars have no possible end???  Have any of them shown even the slightest signs of success? Some we’ve been at for generations, others for decades and yet the problems are no closer to resolution than they were at the beginning. Most importantly, all of them have a massive cost in terms of blood, treasure, jobs, morale and most critically, your acquiescence to new rules, new limits on you, new ‘powers’ , new authority, new violations of every basic and fundamental right that this nation is founded upon.  All of it sold to you as a benefit or function of your safety.

You see… Government has now simply become a business. Like any other business it is susceptible to bloating, bureaucracy and top heavy management. It seeks only to enlarge itself and gain dominating market share. However, in the government business there is no final arbiter to call a limit or reform when things get too unwieldy. No competition to force change. Also, like any business, it must expand or die. No business can exist that simply maintains. By the very nature of humanity, a business strives to grow, expand, gain, and compete. Individual departments (agencies, FDA, EPA, FTC, CIA, ATF, FBI, etc) and management (congress, justice department, courts or you can think of it as Legislative, Justice & Executive) all vie for control and weight within the organization. The competition is fierce and often leads to infighting, exaggeration of success, justification for life and other negative attributes not conducive to effectiveness, efficiency, transparency or limitations on power. Competition is fine for business because in a competitive environment companies must be efficient or lose market share to a competitor, but alas, government wields police powers. That changes things dramatically. Government is a monopoly and when a monopoly has police power to regulate its competitors or outright eliminate them, well then… that changes everything. Our government is eliminating your competition for freedom.

Or looked at another way, government simply takes control of the people, not by competitively producing a better product or service, but by theft and usurpation of the 3 things that our Constitution guarantees. The Right to Life, Liberty and Property. Government produces nothing, creates nothing, manufactures nothing, earns nothing, and yet is the largest user and abuser of our resources.

“The tree of liberty must be refreshed from time to time with the blood of patriots and tyrants.”  —  Thomas Jefferson.  We are fast approaching the final period when ballots will not suffice.  Two times previous to present day, we have seen our nation pushed to the point of bloodshed.  The revolutionary war was fought to free us from a tyrannic monarchy; the civil war was fought to keep the union together.  The next one will be to cut out the cancer of tyranny that has grown within us.   Time is short.
